Loxley Council delays moratorium on new road maintenance

LOXLEY, Alabama — The Loxley Town Council voted to table a proposed resolution adopting a moratorium accepting new roads for maintenance after concerns were expressed during a public hearing Aug. 8 by a representative of a former planned unit development.

Rick Davis, representing property owners of the former Golden Triangle PUD, said the proposed moratorium could affect entitlements agreed upon when the council voted to split the planned unit development in 2012.

In May of 2006 the council approved the Golden Triangle PUD, an undeveloped property of just under 4,000 acres, located north of Interstate 10, bound on the west by U.S. Highway 31 and on the east by Alabama 59.

Zoned as a planned unit development, the property could be developed as residential, commercial or light industrial. But the property was never developed and was eventually sold and split in two, the southern half to Fish River LLC, which includes just under 2,500 acres and the northern half as Fortuna Investments LLC, representing Loxley Triangle LLC.

As part of the agreement passed in 2012, Davis said, the town agreed to provide maintenance for any new road construction developed on the property.

“If the town passes a moratorium on new road construction, that could pose a problem for any future development of the property,” Davis said. “It would put us in a situation where we might need to take steps to ensure that agreement is upheld or find another way to ensure road maintenance in those areas.”

Mayor Billy Middleton said the council would need to approve tabling the matter until the next meeting, which is scheduled for Sept. 12. It will also be discussed during the council’s work session, Aug. 29.

“We need to have our attorneys look at this and decide if we need to change the wording in the agreement in order remain in compliance with this agreement and any others we might have,” Middleton said.

In other business Aug. 8, the council passed several resolutions certifying elections of Middleton and council members who qualified with no opposition in the upcoming municipal election.

Among the council members elected unopposed were Richard Lee Wilson, Place 1; Katherine Q. Breeden, Place 3; Richard L. Teal, Place 4; and Kasey Childress, Place 5.

Only one council member will face opposition in the Aug. 23 election. Place 2 incumbent Jeffrey T. Knight will seek re-election against challenger William Ervin.

Also on Aug. 8, the council:

•Awarded the construction contract for the sewer portion of the town’s 2016 Community Development Block Grant sewer and drainage rehab project to Insituform Technologies Inc. in the amount of $164,940. The project would be paid for through a $350,000 Alabama Department of Economic and Community Affairs grant received in November of 2015.

•Approved costs for administrative services with Grant Management LLC, and engineering services with Goodwin, Mills and Cawood Inc. in the amount of $12,373 for the sewer and drainage project to be paid for with grant funds.

•Approved engineering costs not to exceed $12,000 with Goodwin, Mills & Cawood for drainage improvements in the Lexington Estates subdivision, located on Jenkins Pit Road.

•Approved a bid proposal to replace the roof at town hall from USA Roofing Inc. of Daphne at a cost of $39,600.

•Approved payment of pro rata dues with the South Alabama Regional Planning Commission at a cost of $1,868.

•Approved the purchase of a lawn mower from Parkway Equipment of Loxley at a cost of $7,976.

•Approved a request to send Parks and Recreation Director Glenn Hedden to the Deep South Turf Expo at a cost of $250.

•Renewed the town’s press box banner at J.D. Sellars Stadium with the Robertsdale High School Bear Club (Quarterback Club) at a cost of $450.
