DA: Foley man involved in fatal head-on collision should have been in jail

LOXLEY, Alabama — While the Loxley Police are continuing to investigate a head-on collision that resulted in the death of a Bay Minette woman earlier this month, the Baldwin County District Attorney’s office is investigating the fact that the driver of the other vehicle should have been in prison at the time of the accident.

According to Baldwin County District Attorney Robert Wilters, on March 7, 22-year-old Alec Gregory Dvorak of Foley pled guilty in Baldwin County to a second degree receiving stolen property charge. He was sentenced to serve 69 months, 12 months in a state facility along with three years’ probation.

The charge in Alabama violated Dvorak’s probation on a 2016 charge of fraud and dealing in stolen property in Escambia County, Florida, for which he spent 41 days in the Escambia County Jail facility from June 18 to July 29 of last year.

He was scheduled to serve three-weeks for the probation violation in Escambia County, then be transferred to the Alabama Corrections Center near Montgomery to decide where he would spend his 12-month sentence.

“Somewhere down the line the (transfer) order was not received in Escambia County,” Wilters said. So instead of being transferred to Montgomery from Escambia County, Florida, Dvorak was released.

According to Escambia County, Florida, jail records, Dvorak was booked into the Escambia County Corrections Facility on April 7. He was released on April 26.

On May 8, Dvorak and a passenger were traveling southbound when the 2001 Jeep Grand Cherokee he was driving crossed the center line and struck head-on with a 2014 Hyundai Tucson, driven by 49-year-old Sarah Echols of Bay Minette. She was killed on impact.

Dvorak and his passenger were transported by helicopter to USA Medical Center in Mobile, where Dvorak remains in stable condition. The passenger, who has not been identified, has been released, according to the Loxley Police Department.

Wilters said they are being told that Dvorak will have to undergo therapy for a leg injury before he will be released. Once released from the hospital, Wilters said, he will be transferred to the state facility near Montgomery to be processed.

“It will be up to them to decide what to do with him from there,” Wilters said. “He could serve out his sentence, he could be released on parole, any number of things.”

Records show that Dvorak has spent nearly his entire adult life in and out of prison with a long list of bookings in Baldwin County, dating back to when he was just 18. Baldwin County jail records show three separate bookings from December 2013 to March of 2014 on domestic violence charges.

In 2014, records show Dvorak served eight months on a string of charges, including theft of property, minor in possession of alcohol, a traffic charge, using false identity to obstruct justice, fraudulent use of a credit/debit card and a second degree rape charge.

In 2016 he was booked in March on a receiving stolen property charge, then booked in June and November on fugitive from justice charges before the March 2017 court hearing.

Loxley Police are continuing to investigate the cause of the crash and charges could be pending in the case.
